There is a new machine in town. It's called the Intoxilyzer 8000.
The government is afraid for you to know how it works. Why?
They will not sell this "new and improved" machine to anyone except law enforcement.
But, there is hope. Prior to the machine being placed in service and before the police departments had seen the machine—Bruce was certified twice to operate the Intox 8000 and owns 2 of the machines. He is one of only 7 know attorneys in the U.S. to privately own this machine.
Why is this important? In field tests Bruce had a subject dosed to .08. This level was obtained by measuring and timing the alcohol intake and then testing on various types' machines. After verifying this level, Bruce gave instructions to the subject to vary his breathing pattern. The only thing that changed was that the subject followed Bruce's instructions. This resulted in tests ranging from .05 to .11 and taken within a matter of minutes of each other.
Yes, a variance of almost 40% in each direction and this was using the "new and improved" Intoxilyzer 8000 which the state offers as "scientific" evidence. It is physiologically impossible for the human body to metabolize at such a rate yet the state continues to offer these tests as scientifically reliable.
This is only one of the areas where testing was performed and shortcomings were found.
The manufacturer will not sell the machine to lawyers in hopes of preventing such testing. With these results it is obvious why.
