The Edge Law Firm, along with other firms, challenged the legality of an obnoxious new breathalyzer law all the way to the Oklahoma Supreme court and won.
The Supreme Court overturned a law that would have made it illegal to refuse a breath test. The new law made it a separate crime to refuse a breath. If an officer believed you were driving drunk, demanded you take a breath test, and you refused, you’d be charged with both DUI and failing to take a test.
The Edge Law Firm was outraged that a citizen would be charged with a crime for exercising their Constitutional rights.. They argued that it was unconstitutional to demand citizens give evidence without the opportunity to speak to an attorney first, and the Supreme Court agreed. The law was erased.
