Oklahoma District Court vs. Municipal Court

If you have been charged with DUI, your case will be heard in one either a district or municipal court. Each court handles different types of cases:

  • city municipal court is a local court that serves a specific area.
  • Municipal courts are typically used for trials of a less serious nature, and have a shorter waiting period before trial.
  • State district courts are used for more serious offenses and in specific situations that require the procedure to go through district courts.

Currently there are only two courts in the state that qualify to handle municipal DUI charges: Oklahoma City and Tulsa. All other municipal arrests must go to county courts.

Which Court Will My DUI Be Tried In?

If a DUI arrest is made by a local officer, they are able to choose which court the DUI charges will be filed in. There are a few notable exceptions to this rule.

  • If a state trooper makes the arrest, the charge must be handled in District court.
  • If there are previous DUI charges involved, the case must go to District court.
  • In most other cases, the officer will consider the severity of the offense, taking BAC, behavior, and the circumstances of the arrest into account.
