Under the law, robbery is a wrongful taking of personal property in the possession of another, from their person or immediate presence, and against their will, accomplished by means of force or fear.
First-Degree Robbery
Robbery is different from other theft or larceny crimes because it requires the victim to be present or otherwise aware of the theft at the time it occurred. Robbery must also be accomplished through the use of force or fear. While other theft crimes can occur through deception or stealth, robbery is more direct.
For first-degree robbery the defendant must:
- Inflict serious bodily injury upon the person
- Threaten a person with immediate serious bodily injury
- Intentionally put a person in fear of immediate serious bodily injury, or
- Commit or threaten to commit a felony upon the person.
When accomplished in any other manner, it is robbery in the second degree.
For these reasons, crimes like hold-ups or muggings are usually charged as first-degree robbery, while breaking into a home would generally be charged as a Burglary. First-degree robbery carries a minimum of 10 years with a conviction, and can bring a life sentence if the circumstances are serious enough.
