Answer: A first offense DUI, if it is processed or prosecuted in the district or state court carries up to a year in jail and a $1,000 fine. It is also considered a predicate offense. That means that for 10 years after completion of your sentence, if you were to be charged with another DUI, then it would be filed as a felony offense against you. This applies also if a person were to get a deferred sentence, which means that they would be probated and at the end of probation the case would be dismissed and expunged from the record. It would still be a predicate for 10 years after that expungement period.
