Underage DUI in Oklahoma

It is illegal for anyone under the age of 21 to have a measurable amount of alcohol in his or her system. Under the law this means that if your BAC is at or above .02% or higher, you can be charged with DUI under 21.

Penalties

If you are convicted of DUI under 21, the penalties you can face will depend on your specific BAC and other factors unique to your case.

First offense with a BAC between .01% and .08%:

  • Six month suspension of your license
  • Community service
  • $500 maximum fine

First offense with a BAC at or above .08%:

  • Six months in jail
  • Fine of $300 to $1,000
  • License suspension

Second offense within 10 years:

  • One to five years in jail
  • Maximum $2,500 fine
  • Six month license suspension

There is no distinction between underage and adult DUI convictions under the law. It is important to remember that a conviction for DUI under 21 is something that can follow you for years to come and have serious consequences if you are attending or plan to attend a college or university.
