Question: How can an attorney effectively challenge field sobriety test results in court, and why is specialized training in these tests important for my DUI defense?
Answer: One of the most damaging pieces of evidence very well may be the standardized field sobriety test, or what we call the roadside gymnastics. You should know that these tests are standardized throughout the nation. There’s only one set of tests, there’s only one way they can be given and there’s only one way they can be analyzed and graded.
I know this, because I’ve been through the course. There’s a book about. There’s a course about it and the officer is required to do it, and do it properly if he’s going to ask a jury to consider the information. Not only have I been to the course, I’ve been an instructor, and I’ve instructed other officers and other attorneys on these very things.
Why is this important? Do you really want an attorney that doesn’t know this material? How can an attorney effectively cross examine a police officer on the stand if they don’t know the material, or if they don’t even have the material.
